Who can own a firearm?

1.    A person of good character and good repute in the community in which he lives and who is not subject to any of the disabilities set forth below.
2.    No handgun purchase permit or firearms purchaser identification card shall be issued:
             (a)    to any person who has been convicted of a crime, whether or not armed with or possessing a weapon at the time of such offense
            (b)    to any drug dependent person or to any person who is confined for a mental disorder to a hospital, mental institution or sanitarium, or to any person who is presently an habitual drunkard
            (c)    to any person who suffers from a physical defect or disease which would make it unsafe for him to handle firearms, to any person who has ever been confined for a mental disorder, or to any alcoholic unless any of the foregoing persons produces a certificate of a medical doctor or psychiatrist licensed in New Jersey, or other satisfactory proof, that he is no longer suffering from that particular disability in such a manner that would interfere with or handicap him in the handling of firearms; to any person who knowingly falsifies any information on the application form for a handgun purchase permit or
firearms purchaser identification card
            (d)    to any person under the age of 18 years for a firearms purchaser identification card and to any person under the age of 21 years for a permit to purchase a handgun
            (e)    to any person where the issuance would not be in the interest of the public health, safety or welfare
            (f)    to any person who is subject to a domestic violence court order prohibiting the person from possessing any firearm
            (g)    to any person who as a juvenile was adjudicated delinquent for an offense which, if committed by an adult, would constitute a crime and the offense involved the unlawful use or possession of a firearm
3.    Crime conviction is defined as:
            (a)    aggravated assault, arson, burglary, escape, extortion, homicide, kidnapping, robbery, aggravated sexual assault, sexual assault or endangering the welfare of a child, whether or not armed with or having in his possession any weapon, or any person convicted of a crime pursuant to the provisions of prohibited weapons, unlawful possession, manufacturing, transporting, disposition and defacement of weapons.

How do I buy a handgun?

1.    A 'Handgun Purchase Permit' shall be issued to any person of good character and repute that is not:
            (a)    convicted of a crime
            (b)    drug or alcohol dependent
            (c)    a resident of a mental hospital
            (d)    physically handicapped making it unsafe to handle firearms
            (e)    deemed to be a 'public safety threat'
            (f)    subject to a domestic violence restraining order
            (g)    under the age of 21
2.    The following forms are needed to purchase a handgun:
            (a)    Application to Purchase a Handgun
            (b)    Consent for Mental Health Records Search
            (c)    Fingerprints taken by the Issuing Authority
3.    The financial cost involved is:
            (a)    $2.00 Application Fee
            (b)    $49.00 Fingerprint Fee (varies)
4.    The application shall be granted or denied within:
            (a)    30 days for a resident of NJ
            (b)    45 days for a nonresident
5.    Once the 'Handgun Purchase Permit' is granted:
            (a)    it is valid for 90 days
            (b)    completed copies are forwarded to:
                            (1)    NJSP Superintendent
                            (2)    Local Police Chief
                            (3)    Seller
                            (4)    Purchaser
How do I buy a rifle or shotgun? 1.    A 'Firearms Purchaser Identification Card' shall be issued to any person of good character and repute that is not:
            (a)    convicted of a crime

Can I buy a firearm from an individual? Absolutely. The same rules and laws apply as if the seller was a Federal Firearms Licensed dealer. You should request proof of ownership from this private seller as a precaution.
Somebody gave me a firearm. Can I keep it? 1.    One can inherit a firearm from an heir, as long as this person qualifies to possess the firearm (see: Who can own a firearm?). If one does not qualify, he may retain ownership for 180 days in order to make disposition by sale.

The seller need not be an FFL Dealer.
I'm moving to NJ. How do I register my firearms? Registration of any firearm is strictly voluntary. As long as the firearm was purchased lawfully, it is legal to possess in New Jersey.
How do I transport firearms? Firearms may be transported unloaded and in a closed case or vehicle trunk:
            (a)    between his residences and places of business
            (b)    directly to and from a 'State Filed Charter' Target Range
            (c)    while hunting or fishing with a license in possession
            (d)    to and from a firearm repair shop
Can I carry a firearm on my person? One can carry a legally owned firearm:
            (a)    on his property or business owned by him
            (b)    on a 'State Filed Charter' Target Range
            (c)    while hunting or fishing during open season with a license in possession
            (d)    if he possesses a 'Permit to Carry'
Can I borrow another person's firearm? One may borrow another person's:
        1.    rifle or shotgun:
            (a)    for up to 8 hours on a 'State Filed Charter' Target Range in the presence of the owner
            (d)    while hunting with a rifle or shotgun in the vicinity of the owner
        2.    handgun:
            (a)    for up to 8 hours on a 'State Filed Charter' Target Range in the presence of the owner
    This person must also meet the requirements of ownership (see: Who can own a firearm?), but not necessarily need to possess a 'Handgun Purchase Permit' or 'Firearms Purchaser Identification Card'.
How can I get a 'Permit to Carry' a handgun? 1.    One may obtain a 'Permit to Carry' a handgun for the entire state of NJ provided that the applicant:
            (a)    is not prohibited from purchasing a handgun
            (b)    demonstrates a proficient handling of a handgun
            (c)    has a justifiable need to carry a handgun
2.    An application to carry a handgun must be submitted to the:
            (a)    Chief of Police who:
                        (1)    shall approve or deny the application within 60 days
                        (2)    must approve the application after 60 days from filing
            (b)    County Superior Court who shall:
                        (1)    approve or deny the application

Can I keep a loaded firearm in my house? 1.    Yes, however, if someone under the age of 16 has access to it, the firearm must:
            (a)    be in a locked box, or
            (b)    have a trigger lock, or
            (c)    be in a reasonably secure location

NFA WEAPON SPECIFIC

Can I Legally Own a Machine Gun, Suppressor or Other Class 3 Weapon? The answer depends on several factors. The state in which you must reside (see below) must allow for the possession of the weapon (s). Machine guns, suppressors (silencers), short-barreled shotguns, short-barreled rifles, and any other weapons (AOWs) [e.g., flashlight guns, pistol grip short-barreled Mossberg-type weapons] are classified by the National Firearms Act (NFA) of 1934 as Title II weapons. The NFA is Title II of the Gun Control Act of 1968. Title I weapons are handguns, rifles, etc.

Federal law also provides for an individual to own a Title II NFA weapon. Individuals (Non-FFL holders) may purchase and own machineguns that were made and registered before May 1986. Such machine guns are classified as "Transferable". Suppressors, Short-Barreled Rifles, Short-Barreled Shotguns, and AOWs are still manufactured. Non-FFL holders may only purchase an NFA weapon from a dealer or individual within their own state (same as buying a handgun). If the weapon is located out of state it must be transferred to a class 3 dealer within the state, before transfer to the non FFL purchaser.

Generally, you must meet the following FEDERAL requirements to own a Title II NFA weapon:

Be a US Citizen at least 21 years of age Be of a sound mind Not a person prohibited from receiving a Title I firearm Never convicted of a felony Pay a one-time Federal Transfer Tax on each weapon purchased ( $200.00 for machine guns, suppressors, $5 for AOWs) Complete BATF Form 4 in duplicate, which includes: (1) Obtaining the signature of the "Chief Law Enforcement Officer" (CLEO) in your area signifying that he has no knowledge that you will use your weapon for anything other than lawful purposes, and provide a reason for the "reasonable necessity" to possess the weapon described (2) Provide two (2) sets of fingerprints (3) Provide two 2"x2" recent photographs NOTE: Items 1 through 3 above are not required for corporate ownership of NFA weapons, reducing approval time significantly.

If you have your own corporation or are an officer in a corporation, the corporation can acquire these weapons and you, as a corporate officer, may be able to possess the item (s), take them to the range shooting, etc. just as if they were registered to you, provided you are acting within the confines of the corporation.

It should be noted that in states where it is ILLEGAL for an individual to own, carry, transport, or be in possession of a machinegun or any other NFA weapon, corporate ownership is NOT a viable option (e.g., South Carolina). If the corporation dissolves, the item must be transferred to another individual, corporation, or dealer. If in doubt, check with your local Class III dealer.

After approximately 90 days, during which time the FBI performs a criminal background check, you will receive your Form 4 from BATFE. Only after the transfer is approved can you take possession of your item.
